38. Public inquiry

 

(1) Where, in the course of an investigation of an aircraft accident or aircraft incident, the Aviation Safety Investigation Board considers it necessary that a public inquiry be made into the aircraft accident or aircraft incident, the Chairperson may designate a person or persons, who may be, or may include, the Chairperson, to conduct a public inquiry into that aircraft accident or aircraft incident in accordance with any rules made under section 31 and to report to the Aviation Safety Investigation Board thereon.

 

(2) Any person designated to conduct a public inquiry under this section has and may exercise the powers of a person appointed as an investigator, subject to any restrictions specified in the designation.
