| (1) | A person shall not act as a pilot of a hang-glider, paraglider, or powered parachute regulated under this Part, within the borders of the Republic or its territorial waters unless such person— |
| (a) | holds a relevant valid pilot certificate and an endorsement issued in terms of this Part; or |
| (b) | undergoes training as a learner at an approved DTO, and under the auspices of an approved ARO for the purpose. |
