[Regulation 145.02.9 heading substituted by section 28(a) and (b) of the Thirty-Third Amendment of the Civil Aviation Regulations, 2026, Notice No. 7844, GG55226, dated 21 August 2026 and shall come into operation upon Publication in the Government Gazette, save for Part 92, which shall come into operation upon the Proclamation by the President of the Civil Aviation Amendment Act, 2021 (Act No. 22 of 2021]
| (1) | An AMO approval shall be valid for a period determined by the Director, and such a period shall not exceed five years, calculated from the date of issuance. |
| (2) | An AMO approval holder shall be subject to a continuing surveillance programme and an AMO approval shall remain valid provided that a holder thereof— |
| (a) | submits 90 days before an AMO expiry date, appropriate application for renewal and renewal fee as prescribed in Part 187; |
| (b) | submits 60 days before expiry date of an OpSpec, an appropriate application for its renewal and annual currency fee as prescribed in Part 187; |
| (c) | successfully resolves any finding reported to such operator pursuant to audits and inspections carried out by the Authority; and |
| (d) | continues to meet the requirements for issuance of an AMO approval. |
| (3) | Failure to comply with subregulation (2), shall result in a holder of AMO approval being ineligible to exercise the privileges of an AMO approval. |
| (4) | The Director shall notify an AMO approval holder of any suspension of an AMO approval in writing and such AMO approval holder shall immediately surrender an AMO approval and OpSpec to the Director. |
| (5) | An AMO approval remains valid provided that such AMO approval is not voluntarily surrendered or otherwise suspended or cancelled by the Director. |
| (6) | An AMO approval is not transferable. |
| (7) | A holder of an AMO approval who fails to comply with requirements prescribed in subregulation (2) or whose certificate has expired, surrendered, or suspended, shall acknowledge the reasons in writing within 15 working days of receipt and immediately return such approval and OpSpec to the Director. |
| (8) | Maintenance in terms of this Part may only be conducted by a holder of a current AMO and OpSpec. |
| (9) | A Maintenance approval and OpSpec issued in terms of this Part shall be issued at least 15 days before expiry of current approval or OpSpec. |
| (10) | In case of delays in approval of an AMO or OpSpec in terms of subregulation (9), the Director may elect to issue a temporary AMO approval provided that there is no safety concern and the application requirements are met. |
