| (1) | An administrative penalty imposed in accordance with Regulation 185.03.1 shall be commensurate with the severity of an offence and shall not exceed the amounts prescribed in Table 1 or 2, as applicable. |
| (2) | Where an administrative penalty is issued in a form of a spot fine, such spot fine may be imposed by an enforcement officer immediately upon receipt of an audit or inspection report with a serious regulatory contravention. |
| (3) | A spot fine issued in terms of subregulation (2) shall be issued in line with the amounts provided in Table 1 and Table 2. |
| (4) | If any person fails to pay an administrative penalty imposed on that person in terms of this Part, within the specified period, the Director may, by civil action in a competent court, recover such administrative penalty from such person as prescribed in section 144 of the Act. |
