(1) An aeroplane operator shall—
| (a) | develop an EMP as prescribed in Document SA-CATS 91; |
| (b) | submit an EMP in the prescribed form to the Director for approval in accordance with the information and timelines as prescribed in Document SA-CATS 91; |
| (c) | if a new entrant, submit an EMP to the Director for approval within three months of falling within the scope of applicability; and |
| (d) | submit any material or substantial change on information contained in an EMP to the Director for approval. |
| (2) | An aeroplane operator shall inform the Director of any change to an EMP even if an aeroplane operator does not consider such change to be a material change. |
| (3) | The Director shall inform an aeroplane operator during an approval process of an EMPL, of a level of aggregation for which a reporting of number or flights and CO2 emissions shall be conducted. |
| (4) | An aeroplane operator that falls within the scope of regulation 91.10.1 after 1 January 2021 for the first time without qualifying as a new entrant, shall, within three months of falling within the scope of applicability of regulation 91.10.1, submit an EMP for approval to the Authority in accordance with Document SA-CATS 91. |

| (5) | An aeroplane operator referred to in subregulation (4) shall engage with the Authority as soon as possible in cases where an aeroplane operator falls within the scope of regulation 91.10.1 after 1 January 2021 near the end of year y, or at the beginning of year y+1. |
