Subpart 1 : Safety Management System

140.01.2 Establishment of SMS

(1) An entity referred to in regulation 140.01.1 shall—
(a) establish an SMS as prescribed in Document SA-CATS 140, that is commensurate with the such entity's system description;
(b) develop and submit and SMS manual for the approval of Director either as part of its operations manual or a standalone document as prescribed in Document SA-CATS 140;
(c) ensure the designation of an accountable manager who,  shall have ultimate responsibility and accountability for the implementation and continued effectiveness of SMS;
(d) appoint a safety manager who shall be suitably qualified to perform functions as prescribed in Document SA-CATS 140;
(e) ensure that a safety manager is directly accountable to an accountable manager for the implementation and administration of SMS;
(f) establish an SRB whose composition and functions are prescribed in Document SA-CATS 140;
(g) establish a SAG to oversee the implementation of SMS whose composition and functions are prescribed in Document SA-CATS 140;
(h) have a process for conducting periodic scheduled reviews or audits of SMS; and
(i) develop and submit an implementation plan to the Director.

(2) An accountable manager shall be responsible for the final development and implementation of a corrective action plan arising out of the audits findings in a manner that will ensure the timely resolution of a safety issue.

(3) Where a person responsible for operations or maintenance has delegated any responsibility held under these regulations to another person, such other person shall keep the respective manager currently informed. The respective manager shall maintain responsibility for the corrective action plans arising out of the SMS.
