| (1) |
An ATO approval shall be valid for a period determined by the Director, and such a period shall not exceed five years, calculated from the date of issuance or renewal thereof. |
| (2) |
An ATO approval holder shall be subject to a continuing surveillance programme and an ATO approval shall remain valid provided that an ATO approval holder— |
| (a) |
submits 90 days before an ATO expiry date, an appropriate application for its renewal and renewal fee as prescribed in Part 187; |
| (b) |
submits 60 days before an expiry date of an OpSpec, an appropriate application for its renewal and annual currency fee as prescribed in Part 187; |
| (c) |
successfully resolves any finding reported to such organisation pursuant to audits and inspections carried out by the Authority; and |
| (d) |
continues to meet the requirements for the issuance of an ATO approval. |
| (3) |
Failure to comply with the provisions of subregulation (2) shall result in an ATO approval holder being ineligible to exercise the privileges of an ATO approval. |
| (4) |
The Director shall notify an ATO holder referred to in subregulation (3) of a suspension of its ATO approval, in writing, and such an ATO approval holder shall immediately surrender an ATO approval certificate and OpSpec to the Director. |
| (5) |
An ATO approval shall remain valid provided such ATO approval is not voluntarily surrendered or otherwise suspended or cancelled by the Director. |
| (6) |
An ATO approval shall not be transferable. |
| (7) |
A holder of an ATO approval who receives a notice of suspension in terms of subregulation (4) shall acknowledge the reasons in writing within 15 working days of receipt and surrender such approval to the Director. |
| (8) |
A holder of an ATO approval may apply for a dormancy of an ATO approval for a period not exceeding 36 months by— |
| (a) |
submitting a written application to the Director; |
| (b) |
paying annual currency fees in terms of Part 187; and |
| (c) |
surrendering such ATO approval and OpSpec to the Director. |
| (9) |
A dormant ATO approval and OpSpec shall only be reissued after a renewal audit has been conducted. |
| (10) |
An operation in terms of this Part may only be conducted by a holder of a current ATO approval and OpSpec |
| (11) |
An ATO approval and OpSpec renewed in terms of this Part shall be issued at least 15 days before expiry of current ATO approval or OpSpec. |
| (12) |
In case of delays in the approval of an ATO or OpSpec in terms of subregulation (11), the Director may elect to issue a temporary ATO approval certificate provided that there is no safety concern and the application requirements are met. |
