Subpart 2 : Approval of Aviation Recreation Organisation

149.02.9 Validity and status of approval

[Regulation 149.02.9 heading substituted by section 31(a) of the Thirty-Third Amendment of the Civil Aviation Regulations, 2026, Notice No. 7844, GG55226, dated 21 August 2026 and shall come into operation upon Publication in the Government Gazette, save for Part 92, which shall come into operation upon the Proclamation by the President of the Civil Aviation Amendment Act, 2021 (Act No. 22 of 2021]

 

(1) An ARO approval shall be valid for a period determined by the Director, and such a period shall not exceed five years, calculated from the date of issuance.

 

(2) An ARO approval holder shall be subject to a continuing surveillance programme, and an ARO approval shall remain valid for a period not exceeding five years provided that an ARO approval holder—
(a) submits 90 days before expiry date of approval, an appropriate application for its renewal and renewal fee as prescribed in Part 187;
(b) submits 60 days before anniversary date of approval, an annual currency fee as prescribed in Part 187;
(c) successfully resolves any finding reported pursuant to audits and inspections carried out by the Authority; and
(d) continues to meet the requirements for issuance of an ARO approval.

 

(3) An ARO approval holder who fails to comply with the requirements prescribed in subregulation (2) shall be ineligible to exercise the privileges of ARO approval.

 

(4) The Director shall notify an ARO approval holder of suspension in writing and such ARO approval holder shall immediately surrender an ARO approval to the Director.

 

(5) An ARO approval shall remain valid provided such approval is not voluntarily surrendered or otherwise suspended or cancelled by the Director.

 

(6) An ARO approval holder who fails to comply with the requirements as prescribed in subregulation (2) or whose ARO approval has expired, surrendered, or suspended, shall return such ARO approval to the Director within 15 working days of the date of expiration or surrender.

 

(7) An operation in terms of this Part may only be conducted by a holder of a current ARO approval.

 

(8) An ARO approval issued in terms of this Part shall be issued at least 15 days before expiry of current ARO approval.

 

(9) In case of delays in approval of an ARO in terms of subregulation (8), the Director may elect to issue a temporary ARO approval provided that there is no safety concern and the application requirements are met.
