| (1) | A design organisation approval shall be valid for a period determined by the Director, and such a period shall not exceed five years, calculated from the date of issuance. |
| (2) | A design organisation approval holder shall be subject to a continuing surveillance programme and a design organisation approval certificate shall remain valid provided that a holder of a design organisation approval— |
| (a) | submits 90 days before a design organisation approval expiry date, appropriate application for its renewal and renewal fee as prescribed in Part 187; |
| (b) | submits 60 days before an anniversary date of an approval, an annual currency fee as prescribed in Part 187; |
| (c) | successfully resolves any finding reported to such design organisation pursuant to audits and inspections carried out by the Authority; and |
| (d) | continues to meet the requirements for issuance of a design organisation approval. |
| (3) | Failure to comply with the provisions of subregulation (2), shall result in a holder of a design organisation approval being ineligible to exercise the privileges of such approval. |
| (4) | The Director shall notify a design organisation approval holder of any suspension in writing, and such an organisation shall immediately surrender a design organisation approval to the Director. |
| (5) | A design organisation approval remains valid provided such approval is not voluntarily surrendered or otherwise suspended or cancelled by the Director. |
| (6) | A design organisation approval shall not be transferable. |
| (7) | A holder of a design organisation approval who fails to comply with requirements as prescribed in subregulation (2) or whose design organisation approval has expired, surrendered, or suspended, shall acknowledge the reasons in writing within 15 working days and shall immediately return a design organisation approval to the Director. |
| (8) | Designs in terms of this Part may only be conducted by a holder of a current design organisation approval. |
| (9) | A design organisation approval issued in terms of this Subpart shall be issued at least 15 days before expiry of current design organisation approval. |
| (10) | In case of delays in the processing of an approval of a design organisation in terms of subregulation (9), the Director may elect to issue a temporary approval provided that there is no safety concern and the application requirements are met. |
