| (1) |
Notwithstanding the provisions of regulation 92.01.2, the Commissioner may consider a request to allow the conveyance of dangerous goods in instances— |
| (b) |
other forms of conveyance being inappropriate; or |
| (c) |
where full compliance with the provisions of this Part may be contrary to public interest; and |
| (d) |
special circumstances exist that warrants conveyance of dangerous goods. |
| (2) |
The Commissioner shall in considering a request for the conveyance of dangerous goods as contemplated in subregulation (1), satisfy himself or herself that during such conveyance, acceptable level of safety which is equivalent to the level of safety as prescribed in Document SA-CATS 92 shall be effected under all circumstances. |
| (3) |
Notwithstanding the provisions of regulation 92.01.2, a person may request the Commissioner for conveyance of dangerous good in terms of this Part— |
| (a) |
in instances where in terms of Document SA-CATS 92 forbidden dangerous goods may be carried, with the Commissioner’s approval, on passenger or on cargo aircraft; or |
| (b) |
for any other purposes prevailing as prescribed in Document SA-CATS 92. |
| (4) |
For instances where the Republic is a State of overflight and none of the criteria for granting authorisation are relevant, the Commissioner’s discretionary powers to grant approval for conveyance of dangerous goods in terms of subsection (1) may be granted solely on whether an equivalent level of safety in air transport has been achieved. |
