Part 71 : Remote Pilot Certificate

Subpart 1 : General

71.01.4 Competency and revalidation check

 

(1) A holder of an RPC or rating in terms of this Part shall not exercise the privileges granted by an RPC or rating, unless such a holder maintains competency by complying with the requirements provided in this Part.

 

(2) A holder of an RPC shall undergo a revalidation check before the expiry of a competency or a rating, provided that—
(a) such a holder shall submit to the Director, an application for revalidation of a competency or a rating, in a prescribed form, within 30 days of such revalidation check;
(b) a new expiry date shall be calculated from the last day of the month in which a revalidation check was conducted; and
(c) the Director may grant an extension not exceeding 30 days from the date of expiry of a competency or a rating upon receipt of an application accompanied by written reasons providing exceptional circumstances.

 

(3) A skills test for the issuance of an RPC or rating shall be conducted under the auspices of an ATO and such skills test shall be conducted by a DUE.

 

(4) A revalidation check conducted in terms of subregulation (2) shall be valid until the last day of the 24th month from the date of issuance.

 

(5) A revalidation check shall be conducted on a UAS of the same category for which an RPC is held.

 

(6) A DUE who conducts an initial skills test or revalidation check shall endorse a logbook of an applicant or pilot as prescribed in Document SA-CATS 71.

 

(7) Where an applicant or pilot fails to complete an initial skills test or revalidation check, an applicant or pilot shall—
(a) undergo remedial training at an approved ATO to reach the standard required for the applicable skills test or revalidation; and
(b) undergo a retest of the initial skills test or revalidation check which shall not be conducted within 24 hours of failure to complete.

 

(8) In a case where the ground assessment of the test is successful, but the practical assessment is unsuccessful, a DUE shall only retest on the part relating to the practical assessment.

 

(9) An RPC instructor who conducted remedial training in terms of subregulation (7) shall issue a letter of recommendation to a DUE prior to a retest.

 

(10) An applicant or pilot who was unsuccessful as referred to in subregulation (7) may not exercise the privileges of his or her licence or rating until he or she has successfully passed a re-test.

 

(11) A ground evaluation and the practical part of an initial skills test or revalidation may be conducted on different dates under unforeseen circumstances, not exceeding a period of 30 days.

 

(12) Where the period referred to in subregulation (11) exceeds 30 days, a ground evaluation and practical part of a test shall be repeated.

 

(13) In the case where the practical part of a test is not conducted on the same date as ground evaluation, a DUE shall specify the circumstances for the different dates in the prescribed form.

 

(14) An application for the issuance of an RPC or rating shall be made to the Director in a prescribed form which must be submitted within 30 days of completing a test.

 

(15) The initial expiry date of an RPC or validity of a rating shall be calculated from a last day of a month in which a skills test was conducted.

 

(16) In the event that an RPC holder fails to demonstrate the skills and knowledge referred to in this Part during a revalidation test, the Director shall require an RPC holder to immediately refrain from exercising the privileges of his or her RPC or rating.

 

(17) Where an RPC holder fails to comply with the requirements of a revalidation test, such RPC holder shall—
(a) undergo remedial training at an ATO approved to conduct training in terms of this Part;
(b) obtain a new letter of recommendation from an ATO referred to in paragraph (a) which confirms the content of a remedial training and that an RPC holder has reached the standards required for revalidation of an applicable licence or rating; and
(c) undergo an applicable revalidation test with a DUE appointed by the Director.

 

(18) A person whose RPC or rating has been cancelled by the Director shall comply with the requirements for initial issue of an applicable licence or rating, provided that an application for issuance of a licence or rating shall not be within a period of 24 months calculated from a date of cancellation.

 

(19) An initial skills test or revalidation check shall not be conducted on a flight conducted under a UASOC.
