Part 173 : Flight Procedure Design

Subpart 4 : Flight Validation Organisation (Category C)

173.04.2 Personnel requirements

 

(1) An applicant for a flight validation approval shall employ—
(a) a flight validation pilot to whom contractual authority has been granted to ensure that all activities undertaken by an organisation are carried out in accordance with the requirements prescribed in Document SA-CATS 173, and who shall be vested with powers and duties in respect of compliance with such requirements to—
(i) report directly to management of an organisation on his or her investigations and consultations generally, and with regard to results of liaison referred to in subparagraph (ii);
(ii) establish liaison mechanisms with the Director with a view to ascertain a correct manner of compliance and interpretations of such requirements and facilitate liaison between the Director and an organisation; and
(iii) ensure that flight validations covered by an approval are performed as prescribed in Document SA-CATS 173;
(b) supervisory personnel, if an applicant intends to provide in-service flight procedure design training to a pilot; and
(c) enough qualified flight validation pilots to plan and validate instrument flight procedures that are covered by an approval.

 

(2) A flight validation pilot referred to in subregulation (1) shall meet the minimum requirements as prescribed in Document SA-CATS 173.

 

(3) If an applicant for flight validation approval intends to provide in-service training to a flight validation pilot, a supervisory personnel referred to in subregulation (1) shall be as prescribed in Document SA-CATS 173.

 

(4) An applicant for flight validation approval shall notify the Director of an appointment of a flight validation pilot within 30 days of employing such a person.

 

(5) An applicant for flight validation approval shall establish a procedure for initially assessing and maintaining, competence of personnel involved in flight validation activities covered by an approval, as prescribed in Document SA-CATS 173.

 

(6) If an applicant for a flight validation approval intends to hold an instrument flight procedure design approval and an instrument flight procedure ground validation approval, such applicant shall ensure that—
(a) a chief designer, a chief validator, and a flight validation pilot are separate and different persons; and
(b) a chief designer, chief validator and flight validation pilot are independent of each other in terms of operational activities and authority.
