Part 173 : Flight Procedure Design

Subpart 3 : Approval of Instrument Flight Procedure Ground Validation Organisation (Category B)

173.03.2 Personnel requirements

 

(1) An applicant for instrument flight procedure ground validation approval shall employ—
(a) a chief validator of an organisation concerned, who shall have the authority to ensure that ground validation activities undertaken by an organisation are carried out in accordance with the applicable requirements as specified in this Subpart, and shall be vested with the following powers and responsibilities:
(i) right of access to design and validation work undertaken by the employees of an organisation;
(ii) right to consult with any person with respect to compliance with this Subpart;
(iii) right to suspend any validation activity where such compliance is not effected;
(iv) right to report directly to the accountable manager in terms of Part 140 with respect to any investigation and consultation conducted;
(v) responsibility to establish a liaison mechanism with the Authority in order to facilitate contact and ascertain a correct manner of interpreting and achieving compliance with the regulations; and
(vi) responsibility to ensure that any instrument flight procedure ground validation provided for in an organisation’s approval is performed in a manner as prescribed in Document SA-CATS 173;
(b) supervisory personnel, if an applicant intends to provide on-the-job training to ground validators, who may also act as a chief designer; and
(c) sufficiently qualified ground validators to conduct ground validation of the instrument flight procedures that are provided for in an approval.

 

(2) A chief validator referred to in subregulation (1) shall meet the minimum requirements prescribed in Document SA-CATS 173.

 

(3) If an applicant for instrument flight procedure ground validation approval employs any person as supervisory personnel, such a person shall meet the minimum requirements prescribed in Document SA-CATS 173.

 

(4) A qualified ground validator shall meet the minimum requirements prescribed in Document SA-CATS 173.

 

(5) A chief validator appointed in terms of this regulation may only be appointed after notification to the Director.

 

(6) An applicant shall establish a procedure for—
(a) initially assessing and maintaining the competence of personnel involved in planning validation activities; and
(b) supervising ground validation activities provided for in an approval as prescribed in Document SA-CATS 173.

 

(7) If an applicant for instrument flight procedure ground validation intends to also hold an instrument flight procedure design approval in terms of Subpart 1, such applicant shall ensure that—
(a) a chief designer and a chief validator are separate and different persons; and
(b) a chief designer and chief validator work independent of each other in terms of operational activities and hierarchy.
