Part 173 : Flight Procedure Design

Subpart 1 : General

173.01.11 Issuance of Instrument Flight Procedure design or Validation approval

[Regulation 173.01.11 heading substituted by section 34(a) of the Thirty-Third Amendment of the Civil Aviation Regulations, 2026, Notice No. 7844, GG55226, dated 21 August 2026 and shall come into operation upon Publication in the Government Gazette, save for Part 92, which shall come into operation upon the Proclamation by the President of the Civil Aviation Amendment Act, 2021 (Act No. 22 of 2021]

 

(1) The Director may issue an instrument flight procedure design approval or instrument flight procedure validation approval if the Director is satisfied that—
(a) an applicant meets the requirements prescribed in this Part;
(b) an applicant’s personnel required by this Part are competent personnel;
(c) an applicant’s senior personnel have not held a senior position in an organisation whose approval was revoked by the Director or the Minister; and
(d) the granting of the approval is not contrary to the interests of aviation safety.

(2) An instrument flight procedure design or instrument flight procedure validation approval referred to in subregulation (1) shall contain—
(a) an organisation’s name and principal place of business;
(b) the rating or ratings covered by an approval;
(c) any condition applicable to such approval;
(d) the effective date of an approval; and
(e) any other information that the Director deems necessary.

(3) The Director may grant an approval in respect of only some or all of the ratings sought in the application.

 

(4) A replacement approval shall be issued by the Director on payment of the appropriate fee as prescribed in Part 187, in the event that the original certificate is no longer valid or has been lost or destroyed.
