Subpart 2 : Approval of Manufacturing Organisation

148.02.11 Validity and status of Manufacturing Organisation approval

[Regulation 148.02.11 heading substituted by section 30(a) of the Thirty-Third Amendment of the Civil Aviation Regulations, 2026, Notice No. 7844, GG55226, dated 21 August 2026 and shall come into operation upon Publication in the Government Gazette, save for Part 92, which shall come into operation upon the Proclamation by the President of the Civil Aviation Amendment Act, 2021 (Act No. 22 of 2021]

 

(1) A manufacturing organisation approval shall be valid for a period determined by the Director, and such a period shall not exceed five years, calculated from the date of issuance.

 

(2) A manufacturing organisation approval holder shall be subject to a continuing surveillance programme, and a manufacturing organisation approval shall remain valid provided that a holder of a manufacturing organisation approval shall—
(a) submit 90 days before a manufacturing organisation approval expiry date, appropriate application for its renewal and renewal fee as prescribed in Part 187;
(b) submit 60 days before date of approval, annual currency fee as prescribed in Part 187;
(c) successfully resolves any finding reported to such holder pursuant to audits and inspections carried out by the Authority; and
(d) continues to meet the requirements for the issuance of a manufacturing organisation approval.

 

(3) A holder of manufacturing organisation approval who fails to comply with the requirements prescribed in subregulation (2) shall be ineligible to exercise the privileges of manufacturing organisation approval.

 

(4) The Director shall notify a holder of a manufacturing organisation approval of a suspension in writing, and such a holder shall immediately surrender a manufacturing organisation approval to the Director.

 

(5) A manufacturing organisation approval remains valid provided that such approval is not voluntarily surrendered, suspended, or cancelled by the Director.

 

(6) A manufacturing organisation approval shall not be transferable.

 

(7) A holder of a manufacturing organisation approval who fails to comply with the requirements prescribed in subregulation (2) or whose manufacturing organisation approval has expired, or suspended, shall acknowledge the reasons in writing within 15 working days and immediately return a manufacturing organisation approval to the Director.

 

(8) Manufacturing in terms of this Part may only be conducted by a holder of a current manufacturing organisation approval.

 

(9) A manufacturing organisation approval issued in terms of this Part shall be issued at least 15 days before expiry of current approval.

 

(10) In case of delays in the processing of a manufacturing organisation approval in terms of subregulation (9), the Director may elect to issue a temporary manufacturing organisation approval provided that there is no safety concern and the application requirements are met.
