135.06.4 Validity and status of AOC

 

(1) An AOC shall be valid for a period determined by the Director, and such a period shall not exceed five years, calculated from the date of issuance or renewal thereof.

 

(2) An AOC holder shall be subject to a continuing surveillance programme, and an AOC shall remain valid provided that an AOC holder—
(a) submits 90 days before such AOC expiry date, an appropriate application for renewal and renewal fee as prescribed in Part 187;
(b) submits 60 days before expiry date of an OpSpec, an appropriate application for renewal and annual currency fee as prescribed in Part 187;
(c) successfully resolves any finding reported against such AOC holder pursuant to audits and inspections carried out by the Authority; and
(d) continues to meet the requirements for the issuance of an AOC.

 

(3) Failure to comply with subregulation (2), shall result in an AOC holder being ineligible to exercise the privileges of an AOC.

 

(4) The Director shall notify an AOC holder of a suspension in writing, and such AOC holder shall immediately surrender an AOC and OpSpec to the Director.

 

(5) An AOC remains valid provided such AOC is not voluntarily surrendered to the Director or otherwise suspended or cancelled by the Director.

 

(6) An AOC shall not be transferable.

 

(7) A holder of an AOC who fails to comply with the requirements as provided in subregulation (2) or whose certificate or OpSpec is surrendered or suspended, shall acknowledge the reasons in writing within 15 working days of receipt and shall return such AOC or OpSpec to the Director.

 

(8) An operation in terms of this Part may only be conducted by a holder of a current AOC and OpSpec.

 

(9) An AOC and OpSpec issued in terms of this Part shall be issued at least 15 days before expiry of such AOC or OpSpec.

 

(10) In case of a delay in the approval of an AOC or OpSpec in terms of subregulation (9), the Director may elect to issue a temporary certificate provided that there is no safety concern and all application requirements are met.
