Labour Relations Act, 1995 (Act No. 66 of 1995)

Code of Good Practice on Key Aspects of HIV/Aids and Employment

3. Policy Principles

1) The promotion of equality and non-discrimination between individuals with HIV infection and those without, and between HIV/AIDS and other comparable health/medical conditions.

2) The creation of a supportive environment so that HIV infected employees are able to continue working under normal conditions in their current employment for as long as they are medically fit to do so.

3) The protection of human rights and dignity of people living with HIV or AIDS is essential to the prevention and control of HIV/AIDS.

4) HIV/AIDS impacts disproportionately on women and this should be taken into account in the development of workplace policies and programmes.

5) Consultation, inclusivity and encouraging full participation of all stakeholders are key principles which should underpin every HIV/AIDS policy and programme.
