Brought to you by SA Legal Academy: Explanatory summaries of proposed Private Member’s Bills seeking to amend the National Prosecuting Authority Act, No. 32 of 1998, and the South African Police Service Act, No. 68 of 1995, have been published in the Government Gazette inviting public comment.

In terms of National Assembly procedural rules governing private members, Member of Parliament Dereleen James has announced the intention to introduce the draft legislation to reform key statutory aspects of prosecution oversight and police administration.

Key Aspects of the Proposed Legislation

The gazetted explanatory summaries initiate legislative consideration for two separate draft amendment bills:

  • The draft South African Police Service Amendment Bill, which proposes statutory revisions to operational policing, accountability structures, and administrative procedures within the service.
  • The draft National Prosecuting Authority Amendment Bill, which sets out procedural and governance reforms aimed at the prosecuting authority.

The deadline for public comments and submissions on the proposals set out in the explanatory summaries is 22 November 2026.

What this means for you, your business, or your clients

  • For yourself: Criminal litigation and regulatory practitioners must review proposed structural and procedural amendments to track changes affecting criminal procedure and trial preparation.
  • For your business: Legal firms and compliance practices advising on forensic investigations and criminal proceedings should review the draft provisions to anticipate adjustments to law enforcement interactions and NPA referrals.
  • For your clients: Corporate and individual clients involved in criminal investigations or laying formal charges will be subject to updated procedural mechanisms governing SAPS processing and NPA decision-making once enacted.
