| 1) | An application for the variation or rescission of an arbitration award or ruling must comply with the provisions of rule 19. |
| 2) | The application must be made within 10 days of the date on which the applicant became aware of- |
| a) | the arbitration award or ruling; or |
| b) | a mistake common to the parties to the proceedings. |
| 3) | The commissioner who issued the arbitration award or ruling must hear the application for variation/rescission in terms of section 144 of the Act, provided that the Commission may, on good cause shown, appoint any commissioner to hear the application. |
