| (1) | A foreign AMO located outside the Republic may be issued with an approval— |
| (a) | at the discretion of the Director; |
| (b) | if a foreign AMO complies with the provisions of this Part and the relevant provisions of Part 140; |
| (c) | if an agreement exists between the Authority and a relevant authority of a State where a foreign AMO is located; or |
| (d) | if a foreign AMO seeking approval from the Director. undertakes to pay for an approval and oversight costs charged by the Authority. |
