Protection of Geographical Indications and Designations of Origin used on Agricultural Products intended for sale in the Republic of South Africa

14. Keeping of a Register

 

(1) The Executive Officer shall establish and maintain a Register of all South African Gls, South African designations of origin, foreign Gls and foreign designations of origin, including foreign Gls and foreign designations of origin that form part of international agreements, registered by him or her in terms of regulation 13.

 

(2) The Register shall contain at least the following information:
(a) In the case of all registered South African Gls,South African designations of origin, foreign Gls and foreign designations of origin, excluding foreign Gls and foreign designations of origin that form part of international agreements:
(i) The name of the registered GI or designation of origin.
(ii) The name of the producer or group of producers for whom the GI or designation of origin has been registered first.
(iii) The type of agricultural product.
(iv) The product specifications or a summary of the critical elements of control (i.e. minimum product specifications and any other information deemed necessary) that will be used to verify compliance during inspections.
(v) The name of the country of origin.
(vi) The  name of the  assignee  designated for the agricultural product(s) concerned who will verify compliance in the case of a registered South
(vii) African GI and South African designation of origin.
(viii) The date of registration.
(b) In the case of registered foreign Gls and designations of origin that form part of international agreements:
(i) The name of the registered GI or designation of origin.
(ii) The type of agricultural product.
(iii) The product specifications or a summary of the criticalelements of control (i.e. minimum product specifications and any other information deemed necessary).
(iv) The name of the country of origin.
(v) The date of registration.

 

(3) The Register shall be open for inspection to the public on the Department's website.

 

(4) The Executive Officer may correct any obvious error in, or omission from, the Register.
