Estate Brandy Scheme

6. Conditions for certification

 

(1) Estate brandy may be certified if—
(a) the contents thereof, subject to the provisions of subsection (2), consist of distillates produced from grapes harvested on the estate concerned;
(b) the grapes referred to in paragraph (a) were pressed by virtue of an authority and in accordance with the requirements set out in section 8 of this Scheme;
(c) the wine obtained from such grapes complies with the requirements set out in section 12(1)(a)(ii) of this Scheme;
(d) the provisions of section 12 of this Scheme with regard to the distillation of such wine have been complied with;
(e) the applicable requirements set out in section 13 of this Scheme have been complied in connection therewith;
(f) the containers of that estate brandy comply with the requirements set out in section 15 of this Scheme;
(g) that estate brandy have been bottled in accordance with the provisions of section 16 of this Scheme;
(h) the labels on the containers of that estate brandy have been approved in terms of section 17 of this Scheme;
(i) a seal referred to in section 18 of this Scheme is affixed to each container of that estate brandy;
(j) the applicable notices, permissions, records and conditions have been furnished, obtained, kept or complied with in accordance with the provisions of this Scheme; and
(k) all the other provisions of this Scheme with regard to the estate brandy concerned have been complied with.

 

(2) Up to 10 per cent, calculated on the basis of absolute alcohol, of the contents of an estate brandy may consist of distillates that have not been produced on the estate concerned.

 

(3) Estate brandy compounded of distillates that have been distilled prior to the date of commencement of this Scheme may also be certified if the participant concerned satisfies the Authority that the applicable provisions of this Scheme have been complied with materially with regard to that estate brandy: Provided that no estate brandy shall be thus certified before 1 January 1994.
