Estate Brandy Scheme

1. Definitions

 

In this Scheme, unless the context otherwise indicates—

 

"authority"

means an authority for the pressing of grapes that was granted in terms of section 7 of this Scheme or is deemed to have been granted thereunder;

 

"blending sheet"

means a blending sheet issued to a participant in terms of section 11(2) of this Scheme;

 

"brandy"

means spirits of the classes that are described in the regulations made under the Act as pot still brandy, brandy and vintage brandy;

 

"certify"

means authorisation by the Authority for the use, in connection with the sale of estate brandy, of the particulars referred to in section 5 of this Scheme; and

 

"certification"

has a corresponding meaning;

 

"distillate"

means the product obtained through the distillation of—

(a) wine;
(b) a mixture consisting of wine and a distillate of wine; or
(c) a distillate obtained in terms of paragraph (a) or (b);

 

"distillate record"

means a distillate record issued to a participant in terms of section 12 or 14 of this Scheme;

 

"estate"

means an estate which is defined in terms of section 11 of the Wine of Origin Scheme or is in terms of section 15(2) of the Act deemed to be defined by virtue thereof;

 

"estate brandy"

means brandy produced with a view to the certification thereof;

 

"grapes"

means fruit of plants of Vitis vinifera;

 

"main label"

means the most prominent label on a container in which estate brandy is sold or, if doubt exists as to which one is the most prominent, the label having the largest area;

 

"origin"

with regard to estate brandy, means the estate on which the grapes used to produce that estate brandy have been harvested;

 

"participant"

means a person who produces estate brandy;

 

"produce"

with regard to estate brandy, includes the processing of grapes into wine, the distillation of wine and the distillate obtained therefrom, the maturation of such distillate, the addition or removal of permissible substances to or from such distillate, the blending of different distillates and the dilution of the blended product; and "production" and "produced" have a corresponding meaning;

 

"production sheet"

means a production sheet issued to a participant in terms of section 7(4) of this Scheme;

 

"the Act"

means the Liquor Products Act, 1989 (Act No. 60 of 1989), and also the regulations made thereunder;

 

"the Authority"

means the Wine and Spirit Authority referred to in section 2 of the Act;

 

"wine"

the fermented juice of grapes;

 

"Wine of Origin Scheme"

means the Wine of Origin Scheme published by Government Notice No. R. 1434 of 29 June 1990, as amended from time to time; and

 

"wine record"

means a wine record referred to in section 8(3)(d) of this Scheme.
