| (1) | A ship that fails to comply with the requirements of these regulations may be detained in pursuance of section 243 of the Merchant Shipping Act, unless the failure relates only to the carriage of pollution hazard substances. |
| (2) | Where the failure so relates the ship may be detained in accordance with regulation 10 of the Marine Pollution (BCH Code) Regulations 1998. |
