Licensing Processes and Procedures Regulations, 2010

1. Definitions

 

In these Regulations, any word or expression has the meaning assigned in the Electronic Communications Act, Act No. 36 of 2005, unless otherwise specified:

 

"Act"

means the Electronic Communications Act, 2005 (Act No. 36 of 2005)

 

"applicant"

means an application:

(a) for an Individual Licence;
(b) to amend an Individual Licence;
(c) to renew an Individual Licence;
(d) to transfer or to transfer control of an Individual Licence; or
(e) for a Special Temporary Authorisation

"fees"

means the applicable fees as may be prescribed and payable by an applicant.

 

"historically disadvantaged persons"

[Definition deleted by regulation 2(2.2) of Notice No. 1720, GG48331, dated 30 March 2023]

 

"licence"

means an individual licence;

 

"ITA"

means an invitation to apply for an individual Licence issued by the Authority in terms of section 9(1) of the Act;

 

"these Regulations"

includes any Schedule and Forms annexed to these Regulations;

 

"transfer"

means assign, cede or transfer or transfer of control of a licence from one person to another.
