| (1) | The Registrar must notify the applicant of a variety in writing of his or her intention to evaluate the variety in question in terms of section 38 of the Act and specify— |
| (a) | the reason for the intended evaluation; |
| (b) | the quantity of plants or propagating material required for evaluation; and |
| (c) | the date and place for delivery. |
| (2) | The variety will be evaluated in accordance with international accepted standards for the kind of plant in relation to the respective traits that are to be evaluated. |
