| 9.1 | The iniomation acquired in terms of this MOU is subject to any confidentiality requirements in law and in particular any legislation applicable to the B-BBEE COMMISSION. |
| 9.2 | If one Party comes into possession of information which would be likely to assist the other Party in administrating or enforcing the laws for which it is responsible, the first-mentioned Party may notify the other Party of the existence of that information, subject to 9.1, and 6(a) above and 11.1 below. |
