KwaZulu-Natal Road Traffic Regulations, 2023

1. Definitions

 

For the purposes of these Regulations, the definitions as contained in the National Road Traffic Act, 1996 (Act No. 93 of 1996), apply  with the necessary changes and, in these Regulations, unless the context indicates otherwise—

 

"Committee of Officials"

means a committee established by the Head of Department to determine whether or not a personalised licence number applied for is—

(a) blasphemous;
(b) rude;
(c) gender-biased;
(d) discriminatory;
(e) derogatory;
(f) obscene; or
(g) undesirable on religious grounds;

 

"adjustment licence fees"

means the pro rata fees calculated at one twelfth of the annual licence fees per month from the applicable month until the last day of the month preceding the month of liability for renewal of the relevant licence fees;

 

"blank number plate"

means a blank number plate that bears the —

(a) provincial Coat of Arms and the Provincial ID, manufactured by an identified manufacturer of blank number plates; or
(b) royal Coat of Arms,  and the Provincial ID, manufactured by an identified manufacturer of blank number plates for iSilo;

 

"Department"

means the department responsible for road traffic matters in the Province;

 

"discrete licence numbering system"

means the licence numbering system used in the Province, that denotes a specific area in the Province, such as —

(a) NP: Pietermaritzburg;
(b) ND: Durban; and
(c) NRB: Richards Bay;

 

"embosser of number plates"

means any person or body of persons who embosses licence numbers on blank number plates in compliance with SANS 1116;

 

"Executive Council"

means the Executive Council of the Province contemplated in section 132 of the Constitution of the Republic of South Africa, 1996;

 

"Head of Department"

means the person appointed as head of Department in terms of section 12 of the Public Service Act, 1994 (Proclamation No. 103 of 1994);

 

"iSilo"

means the King of the Zulu Nation as contemplated in regulation 27(2)(bB) of the National Road Traffic Regulations, 2000;

 

"KwaZulu-Natal licence numbering system"

means the format of the letters and figures to be displayed on a licence number plate, a motor trade number plate, and the format of a temporary and special permit, as prescribed by the MEC;

 

"licence mark"

means the acronym of the provincial name as prescribed by the MEC;

 

"licence number series"

means the licence number series for the licence number plates as contemplated in regulation 2, and depicted in Annexure 1;

 

"manufacturer of blank number plates"

means any person or body of persons who manufactures blank number plates in compliance with SANS 1116;

 

"MEC"

means the Member of the Executive Council in the Province responsible for road traffic matters;

 

"Minister"

means the national Minister responsible for road traffic matters;

 

"motor trade numbers"

means a number used by registered—

(a) manufacturers;
(b) importers;
(c) builders;
(d) motor dealers;
(e) motor transport contractors ; and
(f) financial institutions,

to operate an unregistered vehicle on a public road in the course of their business;

 

"number plate"

means a prescribed number plate on which the licence number or motor trade number of a motor vehicle is displayed;

 

"personalised licence number"

means a licence number which must be issued upon application in terms of regulation 28(3) of the National Road Traffic Regulations, 2000;

 

"prescribed fee"

means the fee as prescribed by the MEC from time to time in terms of the KwaZulu-Natal Road Traffic Act, 1997 (Act No. 7 of 1997);

 

"Province"

means the Province of KwaZulu-Natal contemplated in section 103 of the Constitution of the Republic of South Africa, 1996, and "provincial" has a corresponding meaning;

 

"provincial Coat of Arms"

means the provincial Coat of Arms, as contemplated in the Heraldry Act, 1962 (Act No. 18 of 1962);

 

"Provincial ID"

means the name of the Province, that is KWAZULU-NATAL, as contemplated in section 103 of the Constitution of the Republic of South Africa, 1996;

 

"public transport vehicle"

means any motor vehicle that complies with the National Land Transport Act, 2009 (Act No. 5 of 2009);

 

"royal Coat of Arms"

means the Coat of Arms of iSilo;

 

"SANS"

means the South African National Standards;

 

"special permit"

means a permit, valid for three days, which is used for motor vehicle registration and licensing purposes;

 

"specific licence number"

means a specifically requested licence number in the discrete licence numbering system for a particular registering authority area within the Province that is sold at a prescribed fee, by the Department; and

 

"temporary permit"

means a permit, valid for 21 days, which is used for a motor vehicle that is registered and licenced, and roadworthy.
