| (1) | The Minister may, after consultation with the CHE and the public higher education institutions affected by the establishment, establish a national institute for higher education as a juristic person with a specific scope of application. |
| (2) | The Minister must prescribe particulars of the establishment of the national institute for higher education, its board and its specific scope of application by notice in the Gazette. |
