Regulations for the Staff of the Human Rights Commission, 1996

Chapter III : Obligations of Staff

5. Obligations of staff

 

(1) Apart from any function referred to in Part 3 of Schedule B with regard to a specific post or lawfully entrusted to him or her in terms of the Act or these regulations—
(a) every member of staff shall strictly follow all lawful directives and orders given to him or her by the Commission, the chief executive officer or a supervisor;
(b) every supervisor shall be responsible for the efficient management of staff under his or her control; and
(c) every member of staff shall, in promoting the functions of the Commission and the staff, utilize and maintain in a proper manner the property that is in the lawful possession of the Commission.

 

(2) A member of staff shall not without the permission of the chief executive officer accept any gift, commission or reward, in money or otherwise, offered to him or her by virtue of the fact that he or she serves on the staff of the Commission.

 

(3) A member of staff shall not without the permission of the chief executive officer perform or engage himself or herself to perform any remunerative work outside his or her employment in the service of the Commission.

 

(4) Every member of staff shall, with regard to any matter dealt with by him or her, or information which comes to his or her knowledge in the exercise, performance or carrying out of his or her functions as such a member, preserve as such those matters which have been declared confidential by the Commission.

 

(5) No member of staff shall, except for the purpose of the exercise or performance of his or her functions or when required by a court of law or under any law, to do so disclose to any person any information acquired by him or her as such a member or while attending any meeting of the Commission.

 

(6) Every member of staff shall, upon taking office, take an oath or make an affirmation in writing before a member of the Commission in the following form:

 

"I, AB, hereby declare under oath/solemnly affirm that I understand and shall honour the obligation of confidentiality imposed upon me by the Commission and shall not act in contravention thereof.".
