Annexure 3 : Conditions applicable to personalised licence numbers in terms of regulations 28(3) and 29(2) of National Road Traffic Regulations, 2000, for Province

 

ANNEXURE 3

 

Conditions applicable to personalised licence numbers in terms of regulations 28(3) and

29(2) of National Road Traffic Regulations, 2000 for Province

 

1. Establishment of Committee of Officials

 

The Head of Department must appoint a Committee of Officials, consisting of officials from difference racial groups of the Department, to determine whether or not a personalised licence number applied for is—

(a) blasphemous;
(b) rude;
(c) gender-biased;
(d) discriminatory;
(e) derogatory;
(f) obscene; or
(g) undesirable on religious grounds.

 

2. Determination of personalised licence number

 

(1) A personalised licence number issued to any motor vehicle licensed in the Province must—
(a) consist of letters or figures, or a combination of letters and figures, not exceeding seven characters, followed by the letters 'ZN'; and
(b) not be similar in wording to a combination of characters already allocated.

 

(2) The seven characters of a personalised licence number must not—
(a) meet one of the criteria contemplated in item 1;
(b) replace the letter 'I' with the number '1', and vice versa;
(c) replace the letter 'O' with the number '0', and vice versa;
(d) replace the letter 'S' with the number '5', and vice versa; and
(e) replace the letter 'Z' with the number '2', and vice versa.

 

(3) If the Committee of Officials decides that the personalised licence number applied for meets one of the criteria contemplated in item 1, the Committee of Officials must decline the application.

 

3. Manner of application for personalised licence number

 

(1) An application to reserve a personalised licence number must be made to the Choice Numbers Section of a Registering Authority on Form RES PLN1, as contemplated in Annexure 4.

 

(2) If an application is approved, the Choice Numbers Section Registering Authority must issue the approval letter, together with—
(a) the conditions of owning a personalised licence number, as contemplated in this Annexure; and
(b) Form PLN1, as contemplated in Annexure 5.

 

(3) An application, as contemplated in sub-item (1) must be accompanied with acceptable identification, as defined in regulation 1 of the National Road Traffic Regulations, 2000.

 

(4) First-time applications must be considered by the Committee of Officials in terms of—
(a) availability;
(b) suitability; and
(c) on a first-come, first-serve basis.

 

4. Appeals regarding suitability of personalised licence number

 

(1) Any applicant who is aggrieved by the refusal of the Committee of Officials to issue a personalised licence number that he or she applied for, may, within 21 days after notification of the refusal, in writing, appeal to the MEC.

 

(2) After considering the appeal, the MEC must give the decision which he or she deems fit, which decision must be the final decision.

 

5. Payment for personalised licence number

 

(1) The applicant must pay the prescribed once-off fee, upon receipt of the approval documents for the personalised licence number, at a fully function registering authority in the Province.

 

(2) The applicant may not effect any changes to the approved personalised licence number after he or she has paid the fee contemplated in sub-item (1).

 

6. Allocation of personalised licence number to motor vehicle record

 

(1) A personalised licence number may be allocated to a motor vehicle registered in the name of the personalised licence number holder when the prescribed—
(a) allocation and licence fees; and
(b) personalised licence number fee,

have been paid at any full function registering authority.

 

(2) There is no timeframe in which the holder of a personalised licence number is required to allocate that number to a vehicle.

 

7. Sale of vehicle bearing personalised licence number

 

The owner of a vehicle bearing a personalised licence number, or his or her agent, must be issued with a NaTIS-generated licence number at any fullfunction registering authority prior to the sale of the vehicle.

 

8. Retention of provincial personalisedlicence number

 

The retention of a personalised licence number may be made from one motor vehicle to another motor vehicle: Provided that both vehicles belong to the same holder, and may be effected at any full function registering authority.

 

9. Transfer of personalised licence number

 

(1) The transfer of a personalised licence number may be permitted if the holder transfers the number from—
(a) one branch of a company to another branch of that company: Provided that the members of the two branches are the same;
(b) one individual or entity to another; or
(c) the deceased holder to the nominated beneficiary,

at the prescribed transfer fee.

 

(2) The nominated beneficiary, as contemplated in sub-item (1)(c), must submit—
(a) a certified copy of a letter of—
(i) authority; or
(ii) executorship;
(b) a certified copy of the death certificate;
(c) a certified copy of the identity document of the deceased;
(d) a certified copy of the identity document of the beneficiary;
(e) a certified copy of the identity document of the executor or executrix;
(f) a letter from the executor or executrix confirming that ownership of the motor vehicle is transferred to the nominated beneficiary; and
(g) any other documentation prescribed by the MEC.

 

(3) If a close corporation changes to a private company, a merger must be effected at any full function registering  authority, which must automatically transfer the personalised licence number: Provided the members of the close corporation are the same as the members of the private company, and the change does not constitute a change of the legal persona.

 

(4) If the owner of the private company, as contemplated in sub-item (3), does not want to change the close corporation to a private company, he or she must pay the prescribed transfer fees for the transfer of the personalised licence number.

 

10. Stolen vehicles bearing personalised licence number

 

(1) If a motor vehicle allocated a personalised licence number is deregistered or marked as stolen, and not recovered, the personalised licence number must be forfeited, without reimbursement.

 

(2) If a motor vehicle allocated a personalised licence number is deregistered as stolen, and that motor vehicle is recovered,the holder of the personalised licence number must apply to the Choice Number Section Registering Authority, in the prescribed manner, for the reallocation of the personalised licence number, and must supply the following:
(a) Form CCL, obtainable from the South African Police Services, stating that the vehicle has been recovered and removed from the SAPS stolen vehicle register; and
(b) a sworn affidavit in which the holder indemnifies the Department from any loss, damage or harm which may result from the reallocation of the number.

 

11. Relocation from Province to another province

 

(1) If the holder of a personalised licence number relocates to another province, he or she must re-licence his or her motor vehicle at the appropriate registering authority in that province.

 

(2) A holder of a personalised licence number who relocates to another province must surrender his or her personalised licence number to the Department.

 

(3) A holder of a personalised licence number who surrenders his or her personalised licence number, as contemplated in sub-item (2), is not entitled to any re-imbursement of the application fees whatsoever.

 

12. Surrender of personalised licence number

 

(1) If the holder of a personalised licence number no longer requires that personalised licence number, he or she must surrender that personalised licence number to the MEC.

 

(2) The holder of a personalised licence number who surrenders his or her personalised licence number, as contemplated in sub-item (1), is not entitled to any re-imbursement of the application fees whatsoever.

 

13. MEC may change allocated personalised licence number

 

The MEC may change the personalised licence number allocated to a motor vehicle upon the conditions he or she determines, in terms of regulation 29(1) of the National Road Traffic Regulations, 2000.

 

14. Indemnification in respect of personalised licence number

 

The MEC will not be liable for any loss, damage or harm resulting from the acquisition or display of a personalised licence number, under any circumstances whatsoever.

 

15. MEC may amend personalised licence number conditions

 

The MEC may amend the conditions for the application and allocation of personalised licence numbers, from time to time, as he or she deems fit to do so.
