| (1) | A local authority authorised under section 23 to administer any provision of this Act in its area of jurisdiction may, through any person generally or specially authorised by it, prosecute in respect of any contravention of or failure to comply with the provision in question which is alleged to have taken place in the said area. |
| (2) | Any fines recovered pursuant to a prosecution in terms of subsection (1) shall be paid to the local authority concerned. |
| (3) | The provisions of subsection (1) shall not affect the authority of an attorney general to prosecute in respect of the offence in question. |
