Railway Safety Act, 2024 (Act No. 30 of 2024)Chapter 6 : Enforcement41. Railway safety inspector |
(1) | The CEO may appoint a person who meets the requirements determined by the board in respect of suitability, qualifications and training, as a railway safety inspector to exercise the powers and perform the duties contemplated in section 42. |
(2) | The Regulator must, prior to a railway safety inspector exercising any powers and performing any duties in terms of this Act, provide the railway safety inspector with a certificate of appointment signed by the CEO. |
(3) | A railway safety inspector, in conducting any inspection or investigation in terms of this Act— |
(a) | must show his or her certificate of appointment to any person who— |
(i) | is likely to be affected by the railway safety inspector’s actions; or |
(ii) | requests to see that certificate; and |
(b) | may exercise the powers conferred on a peace officer by the Criminal Procedure Act, 1977 (Act No. 51 of 1977). |
(4) | Any person who wilfully hinders the railway safety inspector in the exercise of his or her powers or in the performance of his or her duties in terms of this Act, is guilty of an offence. |
