10. Composition of board

 

(1) The board consists of not less than seven and not more than 13 members who collectively have extensive experience in, and demonstrate knowledge of and acumen in, one or more of the following:
(a) The management of railways and railway operations;
(b) safety in railway transportation, including the impact of human factors;
(c) engineering within the rail environment;
(d) corporate management;
(e) commerce, finance, legal, labour and economic matters;
(f) information and communication technology; and
(g) the transportation of dangerous goods by rail.

 

(2) The persons contemplated in subsection (1) include—
(a) the CEO, by virtue of holding that office;
(b) not more than nine persons representing civil society, including persons from the railway industry, organised labour or communities with experience and knowledge contemplated in subsection (1), but if appointed, such persons do not represent the group from which they were nominated;
(c) one person from the Department, who in the opinion of the Minister is able to assist the board in achieving its objectives;
(d) one person designated by the Minister of Employment and Labour; and
(e) one person designated by the Minister of Police.

 

(3) The board must be broadly representative with regard to race, gender and disability.

 

(4) The majority of persons serving on the board must serve as non-executive board members.
