I, Pemmy Majodina, the Minister of Water and Sanitation, hereby declare in terms of section 98(6) of the National Water Act, 1998 (Act No. 36 of 1998) that—
(a) | The Mooi River and Schoonspruit Water User Association is established. |
(b) | The Association's name is the Mooi River and Schoonspruit Water User Association. |
(c) | The operational area of the Mooi River and Schoonspruit Water User Association (hereinafter indicated as MSWUA), includes the water users abstracting water from the common sources of the Mooi River (C23) and Schoonspruit (C24) catchments from source or through common infrastructure such as canals and dams as well as the dolomite area in the northern part of the Mooi River (C23) and Schoonspruit (C24) catchments. |
(d) | The Northwest dolomite area was identified as the major source of water for the Schoonspruit and Mooi River catchments. Despite chambers within the dolomite area, the total dolomite area is permeable and therefore influences the different chambers and therefore overuse in one area would have a direct impact on the total dolomite area and withn these two catchments. Based on the current situation regarding overuse and a steady decline in available water from the dolomite area to these catchments, the proper management of the total dolomite area is of critical importance to ensure the sustained and continues water supply to these catchments. |
(e) | The proposed area has been rationalised to include all water users which abstract water from common sources and canals but also including the dolomite area north of Ventersdorp in the Mooi River (C23) and Schoonspruit (C24) catchments. |
(f) | All the current government water schemes and current irrigation boards within the Mooi River (C23) and Schoonspruit (C24), will fall into the proposed WUA operational area. |
(g) | Delegation of powers and functions of the Water User Association is per the delegations of 31 March 2023, which will be provided to the Water User Association. |
(h) | The constitution of the Mooi and Schoonspruit River Water User Association has been approved. |
