I, Senzo Mchunu, Minister of Water and Sanitation, hereby declare in terms of section 98(6) of the National Water Act, 1998 (Act No. 36 of 1998) that—
| (a) | The Upington Islands Water User Association is established. |
| (b) | The Association's name is the Upington Islands Water User Association. |
| (c) | The area of operation of the Association is situated within the Vaal-Orange Water Management Area number 4 in drainage areas D71E and D73F in the ZF Mgcawu District Municipality in the Norther Cape Province. The Association's area of responsibility is within the catchment of the Lower Orange River which includes the Gifkloof weir (farm nr. 6 of Vaalkoppies 10) and Upington Irrigation weir (portion 31 of Rouxville West) and all properties till Portion 61 of Farm 392 Eksteenskuil Settlement South of the Orange River and Portion 290, 289, 286, 285, 281 of Blocuso nr 644 on the Northern side of the Orange River. |
| (d) | Any other water resource(s) and/or waterworks situated outside the area described in paragraph (c) above, the Department of Water and Sanitation or the responsible authority may request the Water User Association to control, which are situated under Water Management Area number 4 in the National Water Resource Strategy 3 (NWRS3) in the Province of the Northern Cape, and |
| (e) | Delegation of powers and functions of the Water User Association is per the delegations of 31 March 2023 which will be provided to the Water User Association. |
| (f) | The constitution of the Upington Islands Water User Association has been approved. |
