I, Senzo Mchunu, Minister of Water and Sanitation, hereby declare in terms of section 98(6) of the National Water Act, 1998 (Act No. 36 of 1998) that—
| (a) | The Karkloof Water User Association is established. |
| (b) | The Association's name is the Karkloof Water User Association. |
| (c) | The Area of operation of the Association is existing area of operation of the Karkloof irrigation board which is extended to border onto the U20D quaternary catchment, while the south east boundaries of the association falls partially onto the U20E quaternary catchment. The area of operation falls within the mandate of uMngeni Local Municipality and uMgungundlovu District Municipality and comprises of the following properties: |
Arlington 15561, Avondale 7631, Belvidere 1405, Braco 13499, Clarendon 923, De Magtenburg 985, Essenhyrst 13589, Everdon 981, Ezulwini 15380, Halliwell 924, Hawkstone 15344, Karkloof 1866, Knolle Bank 14297, Libanon 14388, Lot 53 1817, Lot 67 1465, Mansefield 15609, Mansefield 2373, Mooigepierd 910, Pines 14833, Sappi 14694, Shatfon 1014, Sherwood 2173, Sherwood Forest 2077, Siteka 1440, Spitze Kop 970, Start 15458, Stocklands and Oatlands 878, Talavera 2157, The Peak 2189, Thomasville 2120, Umgetu 14830, Vlak Hoek 1371, Welgevonden 969, Weltevreden 945 and Yellow-Wood 13732.
| (d) | Any other water resource(s) and/or waterworks situated outside the area described in paragraph (c) above, the Department of Water and Sanitation or the responsible authority may request the Water User Association to control, which is situated under Water Management Area number 3 in the National Water Resource Strategy 3 (NWRS3) in the Province of the KwaZulu-Natal. |
| (e) | Delegation of powers and functions of the Water User Association is per the delegations of 31 March 2023 which will be provided to the Water User Association. |
| (f) | The constitution of the Mpofana Water User Association has been approved. |
