Debt Collectors Act, 1998

To provide for the establishment of a council, known as the Council for Debt Collectors; to provide for the exercise of control over the occupation of debt collector; to amend the Magistrates' Courts Act, 1944, so as to legalise the recovery of fees or remuneration by registered debt collectors; and to provide for matters connected therewith.

The Debt Collectors Act, 1998 (Act No. 114 of 1998) has been amended by Code of Conduct, Government Gazette 24867, Notice No. R. 663, dated 16 May 2003.

 

The Regulations relating to Debt Collectors, 2003 have been added to the Act as gazetted in GG 24351 dated 7 February, 2003. The forms have not been included.

The Debt Collectors Act has been published in Government Gazette Number 19525, Notice Number 1546 and dated 27 November 1998. Sections 1, 2, 3, 4, 5, 6 and 7 came into operation on 21 January 2000.
