Diving Regulations, 2009

2. Scope of application

 

(1) Subject to subregulation (2), these Regulations apply to all diving operations and all persons engaged in diving operations in the Republic of South Africa or the territorial waters thereof: Provided that all diving operations performed by the South African National Defence Force in accordance with the South African Naval Operations Publication number 96 and all persons involved in those operations, must be regarded as having complied with these Regulations.

 

(2) These Regulations shall not apply to persons who—
(a) use no diving apparatus;
(b) are recreational dive masters or diving instructors;
(c) are engaged in diving projects where they are not considered employees at work;
(d) are medical personnel who have to take part in compression chamber dives in case of an emergency; or
(e) are involved in the care or treatment of patients in a hyperbaric facility in a hospital or other place not under the control of a diving contractor, compressed air work contractor or ROV contractor:

Provided that such facility is accredited by SAUHMA for the treatment of those patients.
