Chapter 4 : Determination of Income Thresholds

19. Determination of the amount

 

(1) The Minister must, with the concurrence of the Minister of Finance, determine the grant amounts and the formula to be used when calculating such amounts for disability, war veteran’s and older person’s grants, by notice in the Gazette.

 

(2) The income of a married person and his or her spouse must, be taken into account when applying the formula referred to in subregulation (1) irrespective of whether the couple is married in or out of community of property.

 

(3) The Agency must, if it is satisfied that an applicant who is married was deserted by his or her spouse for a continuous period of at least three months, or the spouse is unable to support the applicant, grant approval for the marriage not to be taken into consideration when determining the means of the applicant.
