ICASA Gazettes Discussion Paper on Individual ECNS Licensing Inquiry

Posted 30 October 2026 Written by Acts Online

Brought to you by SA Legal Academy: In terms of the Electronic Communications Act, No. 36 of 2005, the Independent Communications Authority of South Africa (ICASA) has published a discussion document advancing its formal inquiry into the licensing of individual electronic communications network services (I-ECNS).

The inquiry was initiated to establish whether individual network service licensing possesses the structural capacity to foster competition and broaden universal access to electronic communications across the Republic. The proceedings were triggered following a ministerial policy directive issued in August 2025, with ICASA formally commencing the consultation process in November 2025 via an industry questionnaire.

The discussion document synthesises the submissions received in response to the November 2025 questionnaire and details the regulator’s preliminary determinations regarding market demand, competitive dynamics, and network licensing thresholds.

Interested stakeholders, licensees, and affected parties have until 9 January 2027 to submit written representations on the preliminary positions and regulatory considerations articulated in the paper.

What this means for you, your business, or your clients

  • For yourself: No direct individual liability; regulatory developments operate at the licensed entity and network infrastructure level.
  • For your business: Telecommunications operators and network infrastructure firms must audit their current ECNS licence status and evaluate the operational impact of potential market entry or altered licence conditions.
  • For your clients: Telecommunications clients, ISPs, and institutional connectivity purchasers should review ICASA’s preliminary findings to assess how revised licensing frameworks may affect wholesale bandwidth pricing and prepare formal submissions ahead of the 9 January 2027 deadline.
