Election and Municipal Governance Legislative Developments
Brought to you by SA Legal Academy: Parliament and the Electoral Commission have advanced a series of statutory and regulatory amendments addressing municipal governance structures, counter-disinformation standards, and national electoral law.
Under the local government framework, the Local Government: Municipal Structures Amendment Bill was formally introduced to Parliament in August 2026 following Cabinet approval on 29 July 2026. The Bill proposes amendments to the Local Government: Municipal Structures Act, No. 117 of 1998 to establish a clear statutory mechanism for coalition formation and executive stability at the municipal level. The measure is currently before the National Assembly’s Portfolio Committee on Cooperative Governance and Traditional Affairs.
Subordinate legislation governing local government has also been updated, with amendments to municipal government regulations gazetted for immediate commencement on 14 October 2026.
Electoral Regulation and IEC Measures
In relation to electoral management and campaign conduct, two distinct instruments have been introduced:
- In September 2026, the Independent Electoral Commission published a counter-disinformation code of conduct for local government elections, which has immediate binding effect on participating entities and political actors.
- In September 2026, the Electoral Laws Amendment Bill was tabled in Parliament to amend the Electoral Commission Act, No. 51 of 1996, targeting systemic administrative and procedural revisions ahead of future national general elections.
- The National Assembly’s Portfolio Committee on Home Affairs has issued a notice inviting written public submissions on the Electoral Laws Amendment Bill.
What this means for you, your business, or your clients
- For yourself: No direct individual obligations arise at this stage; professionals wishing to influence national election administration must track and lodge comments against the Home Affairs Committee call for written submissions on the Electoral Laws Amendment Bill.
- For your business: Advisory and legal firms servicing the local government sector must account for the 14 October 2026 gazetted municipal regulation amendments and prepare compliance workflows for future statutory coalition governance thresholds.
- For your clients: Municipal councils, political entities, and entities contracting with local government must review immediate obligations under the 14 October 2026 regulations and comply with the binding IEC counter-disinformation code during municipal electoral cycles.
