Tongaat Hulett Business Rescue: IDC and Vision Group Agreement Prevents Liquidation
Brought to you by SAnews: An agreement concluded between the Industrial Development Corporation (IDC), Tongaat Hulett’s business rescue practitioners, and the Vision Group has cleared the way for the implementation of the company’s approved business rescue plan and the formal withdrawal of its liquidation application.
In terms of Chapter 6 of the Companies Act, No. 71 of 2008, the restructuring of Tongaat Hulett will proceed following the IDC’s commitment to restructure its post-commencement finance (PCF) into equity. This intervention stabilizes the company’s capital structure, avoiding a formal liquidation process that threatened approximately 250,000 jobs across the sugar industry value chain.
The agreement facilitates the transition of Tongaat Hulett out of active business rescue. The Vision Group, acting as the long-term strategic investor, has committed to funding ongoing operations, supporting local growers and suppliers, and executing the restructuring plan approved by creditors under section 152 of the Companies Act, No. 71 of 2008.
