| (1) | Subject to the Public Service Act, 1994 (Proclamation No. 103 of 1994), and after following the recruitment processes prescribed by and in terms of that Act, the Minister must appoint and designate a person as the Registrar of Plant Breeders’ Rights. |
| (2) | The Registrar is the authority to whom the protection of varieties is entrusted and must perform the functions entrusted to the Registrar under this Act. |
