| (1) | If any propagating material of a variety in respect of which a plant breeder’s right has been granted is sold for the purposes of propagation or for any other purpose, the denomination of that variety must, in such manner as may be prescribed, clearly and legibly appear on a label attached thereto or, if it is packed, clearly and legibly appear on the container. |
| (2) | If a mark is used in conjunction with the denomination of the relevant variety, such mark and denomination must be clearly distinguishable. |
