| (1) | A person may not establish or operate a day care facility or a residential care facility which provides care to five or more people with mental illness and or severe or profound intellectual disability without a licence from the relevant provincial department of health. |
| (2) | A person who operates a day care facility or residential care facility in contravention of subregulation (1) is, upon conviction, liable to a fine or to imprisonment for a period not exceeding 10 years or to both fine and such an imprisonment. |
