If a member of the South African Police Services apprehends a person in terms of section 40(1) of the Act, that member must cause that person to be –
| (a) | taken to a health establishment administered, listed in terms of regulation 12 by the provincial department concerned, for assessment of the mental health status of that person; and |
| (b) | handed over using Form MHCA 22 of the Annexure into custody of the head of the health establishment or any other person designated by the head of the health establishment to receive such persons. |
