| (1) | Voluntary or assisted mental health care users must be assessed and charged according to a patient fee structure. |
| (2) | Appeals against a fee contemplated in subregulation (1) must be directed for consideration to the head of the health establishment concerned. |
| (3) | An involuntary mental health care user is exempted from payment of a fee contemplated in subregulation (1). |
| (4) | An awaiting trial prisoner who is admitted for observation in terms of the Criminal Procedure Act, must be charged in accordance with the tariff agreed to between the Department of Health and the Department of Justice and Constitutional Development must be paid by the latter Department. |
| (5) | A mentally ill prisoner who is admitted for treatment must be charged in accordance with the tariff agreed to between the Department of Health and the Department of Correctional Services and must be paid by the latter Department. |
