Within 30 days after receipt of the documents submitted by the Review Board in terms of sections 34(7) or 35(4), the High Court must in terms of section 36 of the Act in the form of Form MHCA 16 of the Annexure, order –
| (a) | further hospitalisation of the mental health care user and, if necessary, that the financial affairs of such user be managed and administered according to provisions of Chapter VIII of the Act; or |
| (b) | immediate discharge of such user. |
