Revised White Paper on Local Government Launched
Brought to you by SA Legal Academy: The executive has officially launched the revised White Paper on Local Government following Cabinet approval on 23 September 2026, establishing a revised policy trajectory for municipal governance and service delivery.
The revised policy updates the 1998 White Paper on Local Government, originating from a systemic review designed to address ongoing financial, institutional, governance, and service delivery failures at municipal level. A draft iteration was originally published for public consultation in May 2026.
The revised White Paper introduces a differentiated model for local government, intended to tailor governance, administrative, and institutional arrangements according to municipal capacity and operational context. Realising this model is projected to require statutory amendments to primary local government statutes — including the Local Government: Municipal Structures Act, No. 117 of 1998, the Local Government: Municipal Systems Act, No. 32 of 2000, and the Local Government: Municipal Finance Management Act, No. 56 of 2003 — as well as potential constitutional amendments governing municipal allocations and powers.
Transition Management and Implementation
Implementation of the revised policy framework will follow a phased, sequenced reform programme supported by an institutional oversight architecture:
- Establishment of a time-bound local government transition management body to manage structural handovers and ensure execution of institutional commitments; and
- A joint leadership and oversight structure comprising the Department of Cooperative Governance and Traditional Affairs (COGTA), The Presidency, and the National Treasury.
The substantive text of the revised White Paper will take full regulatory effect upon formal gazetting by the Department of Cooperative Governance and Traditional Affairs.
What this means for you, your business, or your clients
- For yourself: Public law, municipal, and regulatory practitioners must prepare for upcoming parliamentary draft amendment bills revising municipal competence allocations, governance structures, and administrative duties.
- For your business: Audit, accounting, and consulting firms servicing local government entities must track transitional mandates and anticipate operational changes to municipal procurement, debt management, and intervention procedures.
- For your clients: Municipal clients, commercial service providers, and local ratepayer bodies will face altered regulatory demarcations, municipal authority designations, and altered intergovernmental compliance requirements once draft legislation is gazetted.
